All products and services of DUT Credit herein provided are subject to the terms and conditions of the applicable agreements governing their use. These terms and conditions are meant to regulate your access to this website and they are to be read together with the applicable terms and conditions governing any transaction(s), product(s) and/or service(s) provided in this website .

Use of Material

The contents of the Site, including but not limited to text, artwork, names, logos, trademarks, service marks, software, video, music, sound, photographs, graphics, illustrations and other material ("Material") are protected by the applicable copyright laws. Modification or use of the content except as expressly provided in these Terms and Conditions violates the DUT Credit's intellectual property rights and you may be in breach of statutory or common law rights which could be the subject of legal action. Neither license, right, title nor intellectual property rights are transferred or granted to you by access to the Site. All content included on the Site, including but not limited to text, graphics, photographs, video and audio clips, streaming data, animation, images, downloadable materials, data compilations and software is the property of the DUT Credit or its content suppliers and is protected by applicable copyright and trademark laws.

The DUT Credit disclaims all liability which may arise from any unauthorized reproduction or use of the contents of the Site.

Indemnity

You hereby irrevocably agree to defend, indemnify, and hold harmless the DUT Credit, its officers, directors, shareholders, employees, independent contractors and agents, from and against any and all claims, actions, liabilities, costs, or demands, including without limitation legal and accounting fees, for all damages directly, indirectly, and/or consequentially resulting or allegedly resulting from your, or you under another person’s authority including without limitation to governmental agencies, use, misuse, or inability to use the Site or any of the Materials contained therein, or your breach of any of these Terms and Conditions or any intellectual property right or proprietary right infringement claim made by a third party against the DUT Credit in connection with your use of this website . We shall promptly notify you of any such claim, proceeding or suit, and you shall be responsible for its defense at your expense. The DUT Credit may participate in the defense of such claim or defense but is not obligated to do so.

Force Majeure

We shall not be responsible for any failure to perform due to unforeseen circumstances or to causes beyond our reasonable control, including but not limited to: acts of God, such as fire, flood, earthquakes or other natural disasters; war, riot, arson, embargoes, acts of civil or military authority, or terrorism; fiber cuts; strikes, or shortages in transportation, facilities, fuel, energy, labor or materials; failure of the telecommunications or information services infrastructure; hacking, SPAM, or any failure of a computer, server or software, for so long as such event continues to delay the DUT Credit’s Site’ performance.

Severability, Non-Waiver and Entire Agreement

If any provision of these terms and conditions is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these terms and conditions, which shall remain in full force and effect. Governing Law and Jurisdiction

By accessing this website and/or using the services provided herein by the DUT Credit, you hereby consent to the exclusive jurisdiction of the Kenyan courts in all disputes arising out of or relating to the use of this website .
